Terms & Conditions of Hire
- Euremica Ltd, the owners will hire the items described for the period and rental shown. In the event of no period of time being specified, either party may terminate the hiring by giving seven days notice.
- The charge for such hire will be the rates in the price list or as agreed, but subject to a minimum period of one week or as agreed. Delivery and collection charged at cost.
- The hire commences on the day the equipment is delivered to the hirer and continues until the equipment is received at our depot in Cleveland. Acceptance of the equipment on site is acceptance of these Terms & Conditions.
- The hire period is one seven consecutive day week inclusive. The hirer may retain equipment for longer than one week at a daily rate without notice to the owner.
- The hirer will in its use of the said equipment observe all the maker’s instructions and other regulations that may be issued for the proper use thereof and shall be entirely responsible for any damage caused to the said equipment through failure to observe such instructions or regulations.
- It will be the hirer’s responsibility:-
- Not to subject the said equipment to any misuse or unfair wear and tear and use in a proper manner.
- To preserve the owner’s or manufacturer’s identification numbers or marks on any nameplate that there should be on the said equipment.
- To keep the said equipment in good condition (fair wear and tear accepted) and to make good to the owners any loss or damage to the equipment however caused (fair wear and tear only expected) whilst the said equipment is in the hirer’s possession.
- In the event of the equipment being found defective on receipt or during use, the company must be notified immediately and we will replace or repair with the minimum possible delay.
- The hirer will not, without the previous consent of the owner, sell or offer for sale, mortgage, pledge, lend or otherwise dispose or part with the possession of the items or any part thereof.
- The hirer will not hold the owner responsible for any loss, damage or injury (including death) to property or persons with regard to use of equipment hired.
- In the case of default of payment, the owners are entitled to recover the said equipment without prior notice being given.
- It is the responsibility of the hirer to arrange adequate insurance on the said equipment to its full replacement value.
- In the event of the equipment being for use abroad or in a hazardous environment, it is the responsibility of the hirer to arrange adequate insurance cover to the full replacement value of the said equipment and to provide a copy of the certificate of insurance to the owners.
- Settlement terms are strictly nett within thirty days of the invoice. The company reserves the right to impose an interest charge on overdue accounts.
Terms & Conditions of Sale
- Euremica Ltd, the owners, will sell the items described, the charge for such sale being the rates in the price list or as agreed.
- The sale commences on the day the equipment is delivered to the buyer, but no title to the items described will pass until payment has been made in full to the owners. Acceptance of the equipment on site is acceptance of these Terms & Conditions.
- The buyer will in its use of the said equipment observe all the maker’s instructions and other regulations that may be issued for the proper use thereof and shall be entirely responsible for any damage caused to the said equipment through failure to observe such instructions or regulations.
- In the event of the equipment being found defective on receipt or during use, the company must be notified immediately and we will replace or repair with the minimum possible delay.
- Notwithstanding delivery and the passing of risk, property in the goods shall not pass to the buyer until the seller has received in cash or cleared funds payment in full of the price agreed for the items.
- Prior to the passing of title. It will be the buyer’s responsibility:-
- Not to subject the said equipment to any misuse or unfair wear and tear, and to use in a proper manner.
- To preserve the owner’s or manufacturer’s identification numbers or marks on any nameplate that there should be on the said equipment.
- To keep the said equipment in good condition (fair wear and tear accepted) and to make good to the owners any loss or damage to the equipment however caused whilst the said equipment is in the buyer’s possession.
- The buyer shall be deemed to be holding the items on behalf of the owner, as such the buyer shall be entitled to resell or use the goods in the ordinary course of business, but shall account to the owner for the proceeds of such sale or otherwise including, in the event of loss, the insurance proceeds and shall keep such proceeds separate for the owners account.
- Until such time as the property in the goods passes to the buyer the owner shall be entitled at any time to require the buyer to deliver up the items and if the buyer fails to do so to enter any third party premises where the goods are stored and to repossess the goods, still retaining any claim against the buyer for subsequent costs or losses incurred in the recovery of the debt or the items concerned.
- It is the responsibility of the buyer to arrange adequate insurance on the equipment to its full replacement value.
- In the event of equipment being for use abroad or in a hazardous environment, it is the responsibility of the buyer to arrange adequate insurance cover to the full replacement value of the said equipment and to provide a copy of the certificate of insurance to the owners.
- In the event that these goods have been resold the resultant debt or payment becomes due directly to the owner.
- The buyer will not hold the owner responsible for any loss, damage or injury (including death) to property or persons with regard to use of equipment bought.
- In the case of default of payment, the owners are entitled to recover the said equipment without prior notice being given.
- In the event of insolvency of the buyer, all outstanding invoices will immediately fall due for payment in full and any goods to which the title has not passes become returnable.
- Settlement terms are strictly nett within thirty days of the invoice. The company reserves the right to impose any interest charge on overdue accounts.
